GENERAL DISPOSITIONS AND OBLIGATIONS OF THE EMPLOYERS AND WORKERS

 FIRST CHAPTER

GENERAL PROVISIONS

ARTICULO 1º. El presente Reglamento es de observancia general en todo el territorio nacional y sus disposiciones son de orden público e interés social, y tiene por objeto establecer las medidas necesarias de prevención de los accidentes y enfermedades de trabajo, tendientes a lograr que la prestación del trabajo se desarrolle en condiciones de seguridad, higiene y medio ambiente adecuados para los trabajadores, conforme a lo dispuesto en la Ley Federal del Trabajo y los Tratados Internacionales celebrados y ratificados por los Estados Unidos Mexicanos en dichas materias.

ARTICLE 1.  The present regulation is of general observance in the whole National territory and its dispositions are for public order and social interest, and have as their objective the establishing of the measures necessary for prevention of accidents and illnesses on the job, aimed at achieving that the providing of labor be developed under conditions of safety, hygiene and adequate environment for the workers, in conformity to the disposition in the Federal Labor Law and the International Treaties created and ratified by the United Mexican States on the subject.

ARTICULO 2º. Para los efectos de este ordenamiento, se entenderá por:

ARTICLE 2.  For the effects of this ordinance, the following are understood to be:

I. Actividades peligrosas:

Es el conjunto de tareas derivadas de los procesos de trabajo, que generan condiciones inseguras y sobreexposición a los agentes físicos, químicos o biológicos, capaces de provocar daño a la salud de los trabajadores o al centro de trabajo;

I. Hazardous activities

Is the collection of tasks derived from the work processes that generate unsafe conditions and  over exposure to physical, chemical or biological agents, with the capacity to cause damage to the health of the workers or the workplace;

II. Centro de trabajo:

Todo aquel lugar, cualquiera que sea su denominación, en el que se realicen actividades de producción, de comercialización o de prestación de servicios, o en el que laboren personas que estén sujetas a una relación de trabajo;

II. The workplace:

Any place, whatever its size, in which  production, commercialization activities, or rendering of services take place, or in which persons that are subject to an employer-employee relationship;

III. Contaminantes del ambiente de trabajo:

Son los agentes físicos, químicos y biológicos capaces de modificar las condiciones del medio ambiente del centro de trabajo, que por sus propiedades, concentración, nivel y tiempo de exposición o acción pueden alterar la salud de los trabajadores;

III. Atmospheric contaminants in the workplace:

Are the physical, chemical and biological agents capable of modifying the condition of the environment in the workplace, that by their nature, concentration, level and time of exposure or action can alter the health of the workers;

IV. Equipo para el transporte de materiales:

Son los vehículos utilizados para el transporte de materiales de cualquier tipo, en forma continua o intermitente entre dos o más estaciones de trabajo destinados al proceso de producción, en los centros de trabajo;

IV.  Equipment for the transport of materials:

Are the vehicles used for the transport of materials of whatever type, in a continuous or intermittent form between two or more work stations designated for production, in the workplace;

V. Ergonomía:

Es la adecuación del lugar de trabajo, equipo, maquinaria y herramientas al trabajador, de acuerdo a sus características físicas y psíquicas, a fin de prevenir accidentes y enfermedades de trabajo y optimizar la actividad de éste con el menor esfuerzo, así como evitar la fatiga y el error humano;

V.  Ergonomy:

Is the adaptation of the workplace, equipment, machinery and tools to the worker, according to his physical and psychic characteristics, with the goal of preventing accidents and illnesses in the workplace and optimizing the activity of the latter with the least effort, as well as avoiding human fatigue and error;

VI. Espacio confinado:

Es un lugar lo suficientemente amplio, con ventilación natural deficiente, configurado de tal manera que una persona puede en su interior desempeñar una tarea asignada, que tiene medios limitados o restringidos para su acceso o salida, que no está diseñado para ser ocupado por una persona en forma continua y en el cual se realizan trabajos específicos ocasionalmente;

VI.  Confined space: 

Is a place sufficiently spacious, with deficient natural ventilation, configured in such a way that a person within it can perform an assigned task, that has limited or restricted ways of access or exit, that is not designed to be occupied by a person continuously and in which specific tasks are occasionally performed;
