ECOLOGICAL EQUILIBRIUM AND THE PROTECTION OF THE
ENVIRONMENT ON THE SUBJECT OF ENVIRONMENTAL AUDIT |

CAPÍTULO PRIMERO
DISPOSICIONES GENERALES

CHAPTER ONE
GENERAL PROVISIONS |
|
Artículo 1o. El presente ordenamiento tiene por objeto
reglamentar las auditorías ambientales previstas en el
artículo 38 BIS de la Ley General del Equilibrio
Ecológico y la Protección al Ambiente. Su aplicación
corresponde al Ejecutivo Federal, a través de la
Secretaría de Medio Ambiente, Recursos Naturales y
Pesca, sin perjuicio de las atribuciones que
correspondan a otras dependencias de la Administración
Pública Federal.

Article 1. The objective of this ordinance is to
regulate the environmental audits detailed in Article 38
add. of the General Law of Ecological Equilibrium and
the Protection of the Environment. Its application
corresponds to the Federal Executive branch, through the
Secretary of Environment, Natural Resources and
Fisheries, without prejudice to the responsibilities
that correspond to other departments of the Federal
Public Administration. |

Artículo 2o. Para los efectos del presente Reglamento se
estará a las definiciones previstas en las Leyes General
del Equilibrio Ecológico y la Protección al Ambiente y
Federal sobre Metrología y Normalización, a las que se
comprenden en sus reglamentos y a las siguientes:

Article 2. For the purposes of this Regulation, the
definitions detailed in the General Law of Ecological
Equilibrium and the Protection of the Environment and
the Federal law on Metrology and Standardization will be
utilized, those that are found in their regulations and
the following:

I.Administración ambiental: Conjunto
sistematizado de acciones que establece una empresa para
el control, preparación, ejecución, registro y
proyección de sus actividades y procesos, con el
propósito de prevenir la contaminación ambiental y
proteger y preservar los recursos naturales;

Environmental Administration: Systemized group of
actions that establish a company for the control,
preparation, execution, registry and projection of their
activities and processes, with the goal of preventing
environmental contamination and protecting and
preserving the natural resources;
|
|
II.
Auditor ambiental:
Persona física acreditada como unidad de verificación en
términos de lo dispuesto por la Ley Federal sobre
Metrología y Normalización para realizar auditorías
ambientales, determinar medidas preventivas y
correctivas derivadas de la realización de una auditoría
ambiental y las demás actividades vinculadas con éstas;

Environmental auditor: Individual
accredited as a Verification unit under terms of the
disposition in the Federal Law on Metrology and
Standardization for performing environmental audits,
determining preventive and corrective measures that
result from the performance of an environmental audit
and other activities related with them;

III.
Auditoría ambiental: Examen exhaustivo de
los equipos y procesos de una empresa, así como de la
contaminación y riesgo que la misma genera, que tiene
por objeto evaluar el cumplimiento de sus políticas
ambientales y requerimientos normativos, con el fin de
determinar las medidas preventivas y correctivas
necesarias para la protección del ambiente y las
acciones que permitan que dicha instalación opere en
pleno cumplimiento de la normatividad ambiental vigente,
así como conforme a normas extranjeras e internacionales
y buenas prácticas de operación e ingeniería aplicables;

III.
Environmental audit: Exhaustive
examination of the equipment and processes of a company,
as well as the contamination and risk that the same
generates, that has as its objective to evaluate the
compliance of their environmental policies and standards
requirements, for the purpose of determining the
preventive and corrective measures necessary for the
protection of the environment and the actions that
permit that said installation operates in full
compliance of the environmental standards in effect, as
well as in conformance with foreign and international
standards and good practices of operation and
engineering applicable;

IV.
Aviso de incorporación: Documento
mediante el cual el responsable del funcionamiento de
una empresa comunica a la Procuraduría su intención de
registrarse en el programa de auditoría ambiental;

IV.
Notice of incorporation: Document through
which the party responsible for the functioning of a
company communicates to the Prosecutor’s Office his
intention of registering himself in the environmental
audit program;

|
V.
Buenas prácticas de operación e
ingeniería: Actividades de diseño, construcción y
operación de un proceso, para la obtención de óptimos
resultados, cuya aplicación ha sido aceptada a través
del tiempo, por la ausencia de reglamentación
específica; |

V.
Good
practices of operation and engineering: Activities of
design, construction and operation of a process, for
obtaining optimum results, whose application has been
accepted over time, for the absence of specific
regulation;
|
|
VI.
Certificado como Industria Limpia:
Reconocimiento que en términos de lo dispuesto por el
artículo 38 BIS, fracción IV, de la Ley, otorga la
Procuraduría para identificar a las industrias que
cumplan de manera integral los compromisos que se
deriven de la realización de las auditorías ambientales;

VI.
Clean
Industry Certificate: Recognition that under the terms
of the disposition in Article 38 add., Section IV, of
the law, the Prosecutor’s Office grants for identifying
the industries that comply in an integrated way, the
commitments that come from the performance of the
environmental audits;
|
|
VII.
Centro Regional: Órgano integrado con
representantes de los diferentes sectores de la
sociedad, con el objeto de apoyar procesos de
mejoramiento del desempeño ambiental de empresas,
principalmente aquellas que sean consideradas como
pequeñas y micros industrias;

VII
Regional center: Body integrated with representative of
the different sectors of society, with the objective of
supporting the processes of improvement of the
environmental compliance of companies, principally those
that are considered as small and micro industries:
|

VIII.
Empresa: Instalación en la que se
realizan actividades industriales, comerciales o de
servicios; |
|
VIII.
Company: Installation in which
industrial, commercial or service activities are
performed;
|
|
IX.
Ley: Ley General del Equilibrio Ecológico
y la Protección al Ambiente;
|
|
IX.
Law:
General Law of Ecological Equilibrium and the Protection
of the Environment;
|
|
X.
Medidas correctivas: Acciones que se
aplican a los equipos, actividades, procesos, programas,
procedimientos, vehículos o sistemas de cualquier
naturaleza de una empresa, incluyendo la instalación de
equipo o la realización de obras, con el objeto de
controlar, minimizar o evitar la contaminación ambiental
o de restaurar, recuperar, compensar, o minimizar los
daños causados al ambiente o a los recursos naturales;

X.
Corrective measures: Actions that are applied to
equipment, activities, processes, programs, procedures,
vehicles or systems of any nature of a company,
including the installation of equipment or the
performance of works, with the objective of controlling,
minimizing or avoiding the environmental contamination
or restoring, recovering, compensating or minimizing the
damages caused to the environment or the natural
resources;

XI.
Medidas preventivas: Acciones que
conjunta o separadamente se aplican a una o más
actividades, procesos, programas, procedimientos,
prácticas, vehículos o sistemas de cualquier naturaleza
de una empresa, incluyendo la instalación de equipo o la
realización de obras, con el objeto de prevenir la
contaminación y los riesgos de contingencias
ambientales; |

XI.
Preventive measures: Actions that together or separately
are applied to one or more activities, processes,
programs, procedures, practices, vehicles or systems of
any nature of a company, including the installation of
equipment or the performance of works, with the
objective of preventing the contamination and the risks
of environmental contingencies;

XII.
Plan de acción: Documento derivado de la
auditoría ambiental que contiene las medidas preventivas
y correctivas, así como los plazos para su realización,
que se compromete a realizar el responsable de una
instalación auditada;
|
|
XII.
Plan
of action: Document resulting from the environmental
audit that contains the preventive and corrective
measures, as well as the time limits for their
performance, that the responsible party of an audited
installation commits to performing;
|
|
XIII.
Procuraduría: Procuraduría Federal de
Protección al Ambiente;
|
|
XIII.
Prosecutor’s Office: Federal Prosecutor’s Office of the
Environmental Protection;
|
|
XIV.
Secretaría: Secretaría de Medio Ambiente,
Recursos Naturales y Pesca, y
|
|
XIV.
Secretary: Secretary of Environment, Natural Resources
and Fisheries, and
|
|
XV.
Términos de referencia: Instrumento
mediante el cual se establecerá la metodología,
requisitos, criterios, parámetros y especificaciones
necesarios para el desarrollo de las auditorías
ambientales, conforme a lo dispuesto en este
ordenamiento. |

XV.
Terms
of reference: Instrument through which will be
established the methodology, requisites, criteria,
parameters and specifications necessary for the putting
into practice of environmental audits, in conformity to
the disposition in this ordinance.
