General Dispositions |

ARTICULO 1o.
El presente Reglamento rige en todo el
territorio nacional y las zonas donde la nación ejerce
su soberanía y jurisdicción, y tiene por objeto
reglamentar la Ley General del Equilibrio Ecológico y la
Protección al Ambiente, en lo que se refiere a la
prevención y control de la contaminación de la
atmósfera. |

ARTICLE 1.
This
Regulation is in effect in the whole National territory
and the zones where the Nation exercises its sovereignty
and jurisdiction, and has as its objective to regulate
the General Law of Ecological Equilibrium and the
Protection of the Environment, as it refers to
prevention and control of the contamination of the
atmosphere. |

ARTICULO 2o.
Las atribuciones que en esta materia
tiene el Estado y que son objeto de la Ley General del
Equilibrio Ecológico y la Protección al Ambiente, serán
ejercidas de manera concurrente por la Federación, las
Entidades Federativas y los Municipios.

ARTICLE 2.
The powers that apply to the State in
this matter and are the object of the General Law of
Ecological Equilibrium and Protection of the Environment
will be exercised concurrently by the Federation, the
Federal Entities and the Municipalities. |
|
ARTICULO 3o.
Son asuntos de competencia Federal, por
tener alcance general en la nación o ser de interés de
la Federación, en materia de prevención y control de la
contaminación de la atmósfera, los que señala el
artículo 5o. de la Ley y en especial los siguientes:

ARTICLE 3.
Those matters stipulated in Article 5 of
the Law are under Federal jurisdiction, of general scope
in the Nation or of interest to the Federation, on
matters of prevention and control of the contamination
of the atmosphere, and the following:

La formulación de los criterios
ecológicos generales; |
|
The
formulation of the general ecological criteria;
|
|
Los que por su naturaleza y complejidad
requieran de la participación de la Federación;
|
|
Those
that by their nature and complexity require the
participation of the Federation; |
|
Las acciones que se realicen en la
materia, en bienes y zonas de jurisdicción federal;
|
|
The
actions that are performed for the purpose, on property
and in zones under Federal jurisdiction;
|
|
Los originados en otros países, que
afecten el equilibrio ecológico dentro del territorio
nacional o las zonas sobre las que la nación ejerce
derecho de soberanía y jurisdicción; |
|
Those
that originate in other countries, that affect the
ecological equilibrium within the National territory or
the zones over which the Nation exercises rights of
sovereignty and jurisdiction; |
|
Los
originados dentro del territorio nacional o las zonas
sobre las que la nación ejerce derechos de soberanía y
jurisdicción, que afecten el equilibrio ecológico de
otros países; |
|
Those
that originate within the National territory or the
zones over which the Nation exercises rights of
sovereignty and jurisdiction, that affect the ecological
equilibrium of other countries; |
|
Los que afecten el equilibrio ecológico
de dos o más Entidades Federativas, y
|
|
Those
that affect the ecological equilibrium of two or more
Federal Entities, and |
|
La protección de la atmósfera en zonas o
en casos de fuentes emisoras de jurisdicción federal.
|
|
The
protection of the atmosphere in zones or in cases
emitting sources under Federal jurisdiction.
|
|
ARTICULO 4o.
Compete a las Entidades Federativas y
Municipios, en el ámbito de sus circunscripciones
territoriales y conforme a la distribución de
atribuciones que se establezca en las leyes locales, los
asuntos señalados en el artículo 6o. de la Ley y en
especial: |

ARTICLE 4.
The matters stipulated in Article 6 of
the Law are the responsibility of the Federal Entities
and Municipalities, in the scope of the territorial
districts and in conformity to the distribution of
powers that are established in the local laws, and in
particular: |
|
I.- La formulación de los criterios
ecológicos particulares en cada Entidad Federativa, que
guarden congruencia con los que en su caso hubiere
formulado la Federación, en las materias a que se
refiere el presente artículo;

The formulation of the particular ecological criteria in
each Federal Entity, that are consistent with those that
for the purpose may have been formulated by the
Federation, in the matters referred to in the present
Article; |
|
La preservación y restauración del
equilibrio ecológico y la protección al ambiente que se
realicen en bienes y zonas de jurisdicción de las
Entidades Federativas y de los Municipios, salvo cuando
se refieran a asuntos reservados a la Federación por la
Ley u otros ordenamientos aplicables;

|
The
preservation and restoration of the ecological
equilibrium and the protection of the environment that
are made on property and in zones under the jurisdiction
of Federal Entities and Municipalities, except when they
refer to matters reserved to the Federation by the Law
or other applicable ordinances; |
|
La prevención y el control de la
contaminación de la atmósfera generada en zonas o por
fuentes emisoras de Jurisdicción estatal o municipal, y
|
|
The
prevention and control of the contamination of the
atmosphere generated in zones or by emitting sources
under State or municipal jurisdiction, and
|
|
La preservación y restauración del
equilibrio ecológico y la protección al ambiente en los
centros de población, en relación con los efectos
derivados de los servicios de alcantarillado, limpia,
mercados y centrales de abasto, panteones, rastros,
tránsito y transporte locales.

The
preservation and restoration of the ecological
equilibrium and the protection of the environment in
population centers, in relation with the affects derived
from services of sewer systems, cleaning, markets and
storage centers, cemeteries, flea markets, transit and
transport centers.
